ESRB switches to computer automated process for online game ratings

UPDATE: The ESRB press office reached out and offered further explanation on how the new process will work, and this post has now been updated accordingly.

The Entertainment Software Ratings Board is the U.S. video game industry’s self-regulatory organization responsible for assigning age ratings to releases and ensuring that all advertising sticks to established guidelines. The industry’s growth in recent years has placed a strain on the ESRB’s ability to rate everything, which is a serious problem when you consider that the big three console makers, Microsoft, Nintendo and Sony, don’t allow unrated game releases on their platforms.

As a result of this, the ratings board is implementing a new system designed to automate some of the process, at the same time placing a great deal of trust in game publishers. Starting today, “the main evaluation of hundreds of games each year” will be relegated to a computer-managed questionnaire “meant to gauge every subtle nuance of violence, sexuality, profanity, drug use, gambling and bodily function that could possibly offend anyone,” The New York Times reports.

The idea now is that publishers will fill out this questionnaire and a computer will analyze the responses across multiple categories to assign a proper rating. Presumably there will be a human somewhere late in the process to double-check the results as well, but the bulk of the work will be done by computers. There is an expectation is that game publishers will report on each game’s content honestly, and really, it behooves them to do so considering that an incorrectly rated game will be caught quickly enough by Internet watchdogs.

The ESRB’s director of communications Eliot Mizrachi told Digital Trends, “Each game will be tested within the first 24-48 hours of availability, and there is an enforcement mechanism by which we can affect changes to ratings that were assigned based on incomplete disclosure. There are consequences for failing to properly disclose content during the rating process.”

The questions run through all of the usual content red flags, including profanity, sexuality, gambling, drug use and so on. It seems to be very detailed too, with profanity, for example, being broken down into six categories: minor profanities, epithets, scatological vulgarities, racial obscenities, sexual vulgarisms and “a final category devoted to one particular three-letter word that refers to both a beast of burden and, colloquially, to a part of human anatomy.” There’s also a section on bodily functions, which asks about ” flatulence sounds, ‘whimsical depictions of feces,’ realistically depicted feces and the ‘act of human (or humanlike character) defecation visually depicted.'”

Major retail releases will still be subjected to the ESRB’s traditional review process. Many do not know this, but the large part of that process never actually puts a game controller into the hands of a ratings classifier. Instead, publishers send over video compilations of game footage meant to highlight the most ratings-relevant moments in a forthcoming release. So ultimately, it’s not such a huge stretch for the ESRB to now be trusting publishers to accurately report on the content of a particular game, since that is what’s been happening all along.

People review-bombing games even before they're released is a common problem on sites like Metacritic. To combat this, Epic Games announced that it's come out with a new user rating system on the Epic Games Store that should address the issues.

The Fortnite maker said on Friday it updated its digital gaming storefront with the user rating system to ensure its games receive direct feedback from the community as they're playing them. It works like this: Epic will randomly ask players to score a game on a five-star scale after playing a game for more than two hours. Their scores will be calculated into the game's overall score, which will appear on the game's Epic Games Store page to help other gamers determine whether or not it's worth playing.

On May 26, Nintendo announced that it was adding Congo's Caper, Rival Turf!, and Pinball to the NES/SNES library on Nintendo Switch Online. The fan reaction was similar to the response after every one of these announcements: Overwhelming negativity.
On Twitter, most of the reactions to this announcement are complaining about this new lineup of games, begging for Super Mario RPG and other missing classic titles to be added, and claiming that Nintendo is lazy and not trying with these new additions. When classic titles like Super Mario RPG: Legend of the Seven Stars don't come to the service in the update, any additions are immediately derided. While there are certainly areas of Nintendo's approach to Nintendo Switch Online worth criticizing, this backlash raises an important question: Do people really want classic games preserved or just the ones they've heard of?

Preserving Pinball
Nowadays in gaming discourse, players are quick to judge and immensely deride something if they're displeased with one aspect of it. We've routinely seen that with Switch Online updates, but the knee-jerk reactions overlook some of the critical preservation the service is doing.
Pinball, for example, might seem like an outdated game at this point, but it was the first commercially released game from the partnership between Kirby developer HAL Laboratory and Nintendo. Its release helped cement HAL Laboratory's relationship with Nintendo and former Nintendo president Satoru Iwata's reputation.
"Looking back, the games that we developed in those days all involved big software ideas where the client was quite sure how to pull it off," Iwata recalled about Pinball's development and the early days of the Nintendo partnership in a writing featured in the Ask Iwata book. "Once we made something of a name for ourselves, we were lauded for our technical abilities, which led to a steady stream of work." In an interview with Used Game Magazine, Iwata would even state that HAL used the NES Pinball game's engine for the popular Pokemon Pinball games.
Not too shabby for a game that's being dragged as a weak Nintendo Switch Online addition. 

Pinball, Congo's Caper, and Rival Turf! might not be all-time classics, but they're enjoyable games that deserve to be preserved and remembered just as much as Super Mario World or The Legend of Zelda. While Pinball and Rival Turf! were featured on previous iterations of Virtual Console, it's also worth noting that Congo's Caper has never been re-released before now. The same goes for other previously derided Nintendo Switch Online additions like The Immortal, Fire 'n Ice, Jelly Boy, Claymates, Bombuzal, and Nightshade.
As fans get angry at Nintendo for not featuring more notable games in these Nintendo Switch Online updates, the good that comes with preserving some of these NES and SNES games is often completely ignored. The reality is that it's already put most of the most important NES and SNES games on this subscription service, especially the former. It's inevitable that Nintendo would spotlight some of these lesser-known games on the service now that just a few stragglers remain.  
Hate the player, not the games
While some of the discourse surrounding additions to Nintendo Switch Online is misguided, Nintendo is not free from blame. I've complained about issues with its subscription service and its library in the past, and see how its current approach to re-releasing classics is flawed in the wake of the Wii, 3DS, and Wii U's Virtual Console. NES and SNES library updates aren't on a consistent schedule, so it's frustrating when a new batch of games is small and made up of obscure titles. Meanwhile, some of the subscription's games have notable technical issues that need to be resolved post-release.

During a Nintendo Direct livestream in 2021, Nintendo announced a new addition to its online service. Dubbed the Nintendo Switch Online + Expansion Pack (a reference to the Expansion Pak hardware you could add to your old Nintendo 64 console), this new service promised to expand the current online service to include both N64 titles as well as Sega Genesis games. The normal service, in addition to standard online play for games that support it, currently gives access to NES and SNES classic games, making this the next logical step for Nintendo's online offerings.

While initially we only knew that this Expansion Pack would be an additional service, and not included in the normal Nintendo Switch Online subscription, we had no idea how much this extra service would cost or how it would function. Since its launch in October 2021, we now know the pricing structure for this extra service and how it will function with the existing online subscription. However, in typical Nintendo fashion, their messaging has left many people confused.
