Pirate Bay to set sail in Netherlands again after court lifts ban on site for two ISPs

Though The Pirate Bay, which is arguably one of the most polarizing, popular and controversial websites in the world, is heavily contested, blocked and stymied in other places, soon many people in the Netherlands will once again be able to gain access to the site.

The Court of the Hague ruled today that it will lift the ban on Pirate Bay in the European nation. The court’s ruling found that the ban infringed on the ability of two ISPs that were ordered to block access to Pirate Bay to operate their businesses freely. On top of overturning the ban, the ruling forces BREIN, the anti-piracy group that fought to have The Pirate Bay ban put in place, to pay legal fees amounting to a total of $445,000. Ouch.

Back in 2010, BREIN fought in court to force Netherlands-based ISPs XS4ALL and Ziggo to block access to Pirate Bay. The ISPs attempted to thwart the forced blocks, but were unsuccessful once BREIN pushed for a full trial, from which they emerged victorious. XS4ALL and Ziggo both filed appeals, stating that blocking Pirate Bay denied people access to information, and that the block was not effective to begin with.

A representative for XS4ALL had this to say about the ruling.

“We are very pleased the court’s verdict. This guarantees freedom of access to information. That is good for Dutch citizens, good for the Internet and good for ISPs who can continue to fulfill their important role neutrally.”

However, that doesn’t mean that Pirate Bay will be accessible to everyone in the Netherlands. Other Dutch ISPs are still in the midst of the appeals process, and those cases won’t be ruled on until later in the year. 

In the meantime, this is a big win for Pirate Bay, torrent users and ISPs like XS4ALL and Ziggo who disagree with the notion that it is their role to police the Internet.
